HyperMail assists our
clients to collect and maintain data on their customers, patrons or
constituents based on federal guidelines under
CAN-SPAM laws and our own service provider's AUP (accepted use policies). Typically the
information we collect on behalf of our clients includes an individual's
electronic mail address, more often referred to as an email address.
Occasionally, we will have clients ask for more detailed data (example: a
zip code, gender or age range). Any data collected by HyperMail on
behalf of our clients is never sold or leased to a third party. Data
collected is presumed to be the property of our clients, unless or
until, any agreement between HyperMail and a client is not met.
Our collection methods may
include, but are not limited to, having recipients fill out a paper form
that is then deposited into a receptacle, often referred to as a "fish
bowl" method. Our data collection methods also include the client or
their end recipient entering the data into an electronic form on HyperMail's
site, the client's site or another site as warranted. Data collected
will always include the end recipient's email address as a mandatory
field. At this point in the process of data collection the recipient has
effectively optioned into the client's list once. Due to the high
volume of SPAM/UCE or otherwise unwanted email and the potential an end
recipient's email address has somehow been provided to HyperMail by mistake it is
necessary to ask the end recipient again if they wish to receive messaging
from any given client. This second step is often referred to as double
opt-in and has become the standard of practice for most companies sending
commercial email. Most service providers, including HyperMail's, now
request or demand the end user be asked a second time "double opt-in" to
be included on a commercial distribution list. To fulfill this
requirement by our service provider's AUP we will send each new email
recipient an initial message asking them to be certain they wish to
receive email from HyperMail on behalf of our client.
HyperMail has maintained a
large number of data including email addresses on behalf of our client's
for many years before some of the current laws, guidelines or regulations
listed above were enacted. It is possible, if you are an end user
"recipient", that our company may have had your email address in our
records or on a list prior to the laws, guidelines or regulations listed
above. Our delivery software dynamically creates a removal link at
the bottom of every message sent where any and all recipients can click on
that link to be removed immediately in one step or one click of the mouse.
If you have received a message by mistake, for any reason, on behalf of
HyperMail and our clients we sincerely apologize and ask that you click
the "remove" link at the bottom of the message you received in
